ENHANCED LIABILITY WAIVER RELEASE & ASSUMPTION OF RISK

1. Program Scope

Elite 1s Basketball (“Elite 1s”) is a competitive AAU basketball organization offering team practices, games, tournaments, showcases, clinics, private training, strength and conditioning, VertiMax training, speed, agility, plyometric, resistance-based training, weight training, and performance enhancement programs, including activities conducted at third-party facilities, during travel, or at AAU-sanctioned or non-sanctioned events (collectively, the “Activities”).

2. Assumption of Risk

I understand and acknowledge that participation in competitive AAU basketball and advanced athletic performance training involves inherent and unavoidable risks, including but not limited to:
•    Sprains, strains, muscle tears, ligament injuries, and overuse injuries
•    Fractures, dislocations, and joint injuries
•    Head, neck, and spinal injuries, including concussions
•    Injuries resulting from VertiMax equipment, resistance bands, harnesses, weighted devices, speed cords, and plyometric apparatus
•    Injuries resulting from player contact, falls, collisions, or surfaces
•    Injuries resulting from improper execution, fatigue, dehydration, or exertion
•    Aggravation of pre-existing conditions

I voluntarily and knowingly assume all risks, whether foreseen or unforeseen, associated with my child’s participation in the Activities.

3. Release, Waiver & Covenant Not to Sue

To the maximum extent permitted under New Jersey law, I, on behalf of myself and my child, hereby release, waive, discharge, and covenant not to sue Elite 1s Basketball, its owners, officers, directors, coaches, trainers, strength and conditioning staff, VertiMax trainers, independent contractors, volunteers, facilities, event operators, sponsors, affiliates, and agents (collectively, the “Released Parties”) from any and all claims, liabilities, demands, damages, costs, or causes of action arising out of or related to any injury, illness, disability, or loss sustained during or in connection with the Activities.

This release applies to claims arising from ordinary negligence of the Released Parties, but does not apply to conduct constituting gross negligence or willful misconduct, as defined under New Jersey law.

4. Medical Clearance & Emergency Authorization

I certify that my child is physically and medically capable of participating in competitive basketball and performance training. I authorize Elite 1s Basketball and its representatives to administer or obtain emergency medical care as deemed necessary. I accept full financial responsibility for all medical expenses incurred.

5. Insurance Responsibility

I understand that Elite 1s Basketball does not provide primary medical insurance coverage for participants. I acknowledge that I am solely responsible for maintaining medical insurance coverage for my child.

6. Compliance, Safety & Removal

I acknowledge that participation is conditioned upon compliance with all training protocols, safety instructions, and coaching directives. Elite 1s Basketball reserves the right to restrict, suspend, or remove any participant whose conduct or condition poses a safety risk, without refund.

7. Photo, Video & Media Release

I grant Elite 1s Basketball the irrevocable right to use photographs, video recordings, and audio recordings of my child for training, promotional, marketing, educational, and social media purposes, without compensation or further consent.

8. Severability

If any portion of this agreement is found unenforceable under New Jersey law, the remaining provisions shall remain in full force and effect.

9. Governing Law & Venue

This agreement shall be governed by and interpreted according to the laws of the State of New Jersey, and any legal action shall be brought exclusively in a court of competent jurisdiction within New Jersey.

10. Acknowledgment & Signature

I acknowledge that I have carefully read and fully understand this agreement. I understand that by signing below, I am waiving substantial legal rights, including the right to sue, on behalf of myself and my child.

Choice of Law: I understand and agree that the law of the State of New Jersey will apply to this contract.

I HAVE CAREFULLY READ AND FULLY UNDERSTAND ALL PROVISIONS OF THIS RELEASE, AND FREELY AND KNOWINGLY ASSUME THE RISKS AND WAIVE MY RIGHTS CONCERNING LIABILITY AS DESCRIBED ABOVE

As the parent/guardian of the child named above, I hereby give my full consent and approval for my child to participate in any activity of Elite 1s Basketball, LLC which may include Tryouts, Practices, Clinics, Camps, and/or Basketball Games. I also waive, release, and hold harmless Coach Naeem Syed and any staff member(s) of Elite 1s Basketball, LLC, and/or any facility Elite 1s Basketball, LLC utilizes, for any injury that the child may suffer while in the course of participating in any activity including but not limited to travel to an event. By signing this waiver, I also give permission for Elite 1s Basketball, LLC to photograph any activity to promote Elite 1s Basketball, LLC in Social Media, Media Publications, or Company Literature. I am the parent or legal guardian of the minor named above. I have the legal right to consent to and, by signing below, I hereby do consent to the terms and conditions of this Release.
